1 - PREAMBLE


This privacy policy applies to the site: https://www.linguifamily.com and the associated blog https://blog.linguifamily.com
It completes the General Terms and Conditions of the site, it will explain how B LINGUI SAS processes the personal data of users. Personal data will be defined as any information relating to an identified or identifiable natural person.

2 - GENERAL PRINCIPLES IN DATA COLLECTION AND PROCESSING


In accordance with Article 5 of European Regulation 2016/679 (hereinafter referred to as the "GDPR"), personal data are:

- Adequate, relevant and limited to what is necessary for the purposes for which they are processed (data minimisation);

- Accurate and, if necessary, kept up to date; all reasonable steps must be taken to ensure that personal data which are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay (accuracy);

- Preserved in a form which permits identification of the data subjects for a period not exceeding that necessary for the purposes for which they are processed (conservation limitation);

- Processed in such a way as to ensure appropriate security of personal data, including protection against unauthorised or unlawful processing and against accidental loss, destruction or damage, by means of appropriate technical or organisational measures (integrity and confidentiality);

In accordance with Article 6 of the GDPR, B LINGUI SAS states that the collection and processing of such personal data is only possible if:

- The data subject has consented to the processing of his or her personal data for one or more specific purposes;

- The processing is necessary for the performance of a contract to which the data subject is a party or for the performance of pre-contractual measures taken at the request of the data subject;

- The processing is necessary for compliance with a legal obligation to which the controller is subject;

- The processing is necessary to safeguard the vital interests of the data subject or another natural person;

- The processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

- Processing is necessary for the legitimate interests pursued by the controller or by a third party, unless the interests or fundamental rights and freedoms of the data subject which require the protection of personal data prevail, in particular where the data subject is a minor.

A - Data collected and collection method

The site https://www.linguifamily.com collects the following data:
Mandatory data collected when creating a host family ad or a traveler account:
- Account information:
When creating your account we will ask you to provide certain information necessary for the proper functioning of the services requested.
- Name, first names, date of birth, gender,
- Postal address, e-mail address, mobile phone number,
- Mother tongue, nationality,
- Password,


Mandatory data specific to the creation of a host family ad:
- Main language spoken at home
- Nearest major city
- Presentation of the family
- List of family members: surname, first names, date of birth, gender, family status
- Photos

Optional data collected:
- Skype ID
- Home phone number
- Profile photo
- Copy of identity document.

B - Data retention period

The data are kept for:
- 3 years after your last use of our Platforms, if you have not closed your account
- 1 year after the closure of your account, unless you have received a negative notice or an alert, in which case your data will be kept for 2 years following the last negative notice or alert received if this is longer.
- Sensitive data (identity card) are not stored.

C - Purposes of data collection

The data collected in this way are used for the following purposes:
- Send you information about our services (such as booking confirmations) by e-mail, SMS or any other means of communication ;
- Collect your payments or send you the amounts collected on your behalf ;
- Allow you to customize your profile on our Platforms ;
- Give you access and allow you to communicate with our site
- Ensure compliance with applicable legislation, our terms and conditions of use, and our privacy policy. In the event of any breach by you, we may suspend your account on our site ;
- With your consent, send you marketing, advertising and promotional messages and information about the use of our services, booking procedures, or suggest and advise you of goods or services that may be of interest to you.
- In order to inform you of changes to our services ;

D - Data transmission

The personal data collected by the site are not transmitted to any third party. The data is processed, only, by the site host.

Payment data is transmitted to Stripe, which secures the collection of this data, Stripe claims to establish protection in accordance with the Data Protection Shield, and therefore applies an adequate level of protection to a transfer of your Personal Data to the United States.

E - Data hosting

The website https:// www.linguifamily.com is hosted by OVH, a company located at 2 rue Kellermann in Roubaix (59100) in France, which can be reached at (+33) 0 820 698 765.

ARTICLE 4: DATA PROCESSING RESPONSIBLE


The data controller undertakes to collect only the data necessary for processing and to secure this data. He undertakes to always inform the user of the purposes for which this data has been collected.
He undertakes to inform the user by any means if the integrity, confidentiality or security of the data is compromised.

You have a right to receive a copy of your personal data (right of access).
You may also request the deletion and/or rectification of your personal data (right of deletion and right of rectification).

You have the right to file a complaint with the competent supervisory authority or to obtain compensation from the competent courts if you consider that we have not respected your rights.


ARTICLE 6: USE OF "COOKIES" FILES


A cookie is a small text file stored on a user's computer when they visit a web page. These files make it easier and better for the user to navigate and allow statistical studies.
